These Terms and Conditions ("Agreement") govern the use of the Almsgate website and the engagement of services offered by Almsgate, 6 Jalan Puchong, Bandar Puteri, 47100 Puchong, Selangor, Malaysia. By using this website or engaging any Almsgate service, you confirm that you have read, understood, and agreed to be bound by these terms. If you do not agree, please do not use this website or engage our services.
Key Terms Used in This Agreement
- "Service" — any of the three documentary and clerical services offered by Almsgate: the Referral Preparation Session, Courtyard Sorting, and the Full Documentation Engagement, as described on the Almsgate website.
- "Client" or "You" — any individual, family member, or entity that uses this website or engages an Almsgate service.
- "We", "Us", "Our" — Almsgate, operating from 6 Jalan Puchong, Bandar Puteri, 47100 Puchong, Selangor, Malaysia.
- "Engagement" — a formal agreement to deliver a specific Almsgate service, confirmed in writing through a scope agreement.
- "Deliverables" — the outputs produced during an Engagement, which may include bound files, question sheets, document checklists, chronologies, gap lists, and practitioner directories.
- "Website" — the Almsgate website at https://almsgategas.world and all pages contained within it.
How This Agreement Is Formed
By submitting the contact form on this website, responding affirmatively to a service proposal, or signing a scope agreement, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under the laws of Malaysia. If you are acting on behalf of a family or group, you represent that you are authorised to do so.
Use of this website alone constitutes acceptance of these Terms. Engagement of a Service constitutes a separate contractual commitment governed by both these Terms and the written scope agreement issued for that Service.
What Almsgate Provides
Almsgate provides documentary and clerical support services to families dealing with inheritance and family archive matters. All services are strictly limited to the following types of work: document sorting, indexing, labelling, chronology drafting based on document content, gap identification, question preparation for professional appointments, and the production of practitioner directories drawn from publicly available records.
Almsgate does not provide legal advice, financial advice, tax advice, estate administration, or any service requiring a professional licence in Malaysia or any other jurisdiction. Nothing produced by Almsgate should be construed as legal, financial, or professional guidance of any kind.
Services are available to clients located in Malaysia, with in-person appointments at our Puchong premises.
What We Ask of You
- Provide accurate information when enquiring and engaging services
- Attend scheduled appointments or notify us within 48 hours if rescheduling is needed
- Ensure that documents brought to appointments are your property or that you have authority to share them
- Use deliverables only for the personal estate and archival purposes for which they were produced
- Not request that Almsgate provide legal, financial, or professional advice, or represent the client in any matter
- Not attempt to use this website or our services for any unlawful purpose
Ownership of Materials
All content on the Almsgate website — including text, layout, design, and methodology descriptions — is the intellectual property of Almsgate and may not be reproduced without written permission.
Deliverables produced during an Engagement are created from the client's own documents and information. The bound file, digital mirror, question sheet, and all other outputs are the property of the client upon payment of the agreed fee. Almsgate retains no claim over the content of deliverables once delivered.
Fees, Payment, and Cancellation
Service fees are stated in Malaysian Ringgit (RM) and are inclusive of all standard outputs as described in the scope agreement. Fees are payable as agreed in the scope agreement, typically with a deposit at the time of booking and the balance at the close of the Engagement.
Accepted payment methods include bank transfer and cash. Receipts will be provided for all payments.
If a client cancels an Engagement more than five working days before the first appointment, any deposit paid will be refunded in full. Cancellations within five working days of the first appointment may result in retention of the deposit to cover preparation costs. Cancellations after work has commenced are subject to a fee proportionate to the work completed.
Scope, Timeline, and Changes
The scope of each Engagement is set out in a written scope agreement provided before work begins. Changes to the scope requested by the client after the scope agreement is signed may result in revised fees, which will be agreed in writing before additional work is carried out.
Almsgate will use reasonable efforts to meet agreed timelines. Delays caused by client unavailability, incomplete documents, or circumstances outside Almsgate's control will not give rise to liability on the part of Almsgate.
Deliverables are reviewed with the client at the close-out meeting. The client has the opportunity to request corrections at that meeting. Once the client has signed off on the deliverables, the Engagement is considered complete.
Limits on What We Provide
Almsgate provides document sorting and preparation services. We make no representation that any deliverable will achieve a specific legal, financial, or estate-related outcome. The usefulness of our deliverables depends in part on the completeness of the documents the client provides and the choices the client makes in using them.
Nothing on this website or in any Almsgate deliverable constitutes legal, financial, or professional advice. Clients must seek such advice from appropriately qualified and registered professionals in Malaysia.
Our Liability to You
To the fullest extent permitted by Malaysian law, Almsgate's total liability to any client in connection with any Engagement or use of this website shall not exceed the total fees paid by that client for the relevant Engagement.
Almsgate is not liable for any indirect, consequential, or incidental loss arising from the use of our services or deliverables, including losses arising from decisions made by the client or third parties on the basis of our deliverables.
Client Indemnity
You agree to indemnify and hold Almsgate harmless from any claims, damages, or expenses (including reasonable legal costs) arising from your use of our services in breach of this Agreement, your provision of inaccurate information, or your failure to obtain necessary authorisations before bringing documents to an Engagement.
Ending an Engagement
Either party may terminate an Engagement in writing at any time. Upon termination, Almsgate will provide the client with all work completed to date and return all original documents. Fees for work completed up to the termination date are payable.
Almsgate reserves the right to refuse or terminate an Engagement if a client requests services that fall outside our documented scope, or if a client's conduct makes the delivery of services impracticable.
Resolving Disagreements
These Terms are governed by the laws of Malaysia. Any dispute arising under this Agreement will first be referred to informal discussion between the parties, with a view to resolution within 21 days.
If informal resolution is not achieved, disputes may be referred to mediation through the Malaysian Mediation Centre before any court proceedings are commenced. The courts of Malaysia shall have exclusive jurisdiction over any unresolved dispute.
Miscellaneous
- Entire agreement: This Agreement and any written scope agreement constitute the entire agreement between the parties and supersede all prior communications.
- Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure by Almsgate to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our rights with reasonable notice.
- Notices: Formal notices may be sent to [email protected] or by post to our Puchong address.
Updates to This Agreement
We may update these Terms from time to time. The current version will always appear on this page with a revised Last Updated date. Continued use of the website or engagement of services following an update constitutes acceptance of the revised Terms.
